These Terms & Conditions govern the purchase and use of products and services offered by Chirp Handpans, operated by Chirp Handpans / Chirag Vaitheeswaran, Bengaluru, India.
By placing an order through our website, you acknowledge that you have read, understood, and agreed to these Terms & Conditions.
1. Products and Handmade Instruments
Every Chirp Handpan is individually handcrafted, shaped, finished and tuned in our workshop in India.
Because our instruments are handmade, no two instruments will be completely identical. Minor variations in colour, surface texture, finish, hammer marks, engraving and other visual characteristics may occur and are a natural part of the manufacturing process.
Sound characteristics may also vary slightly between individual instruments, even when they are made to the same scale and specification.
Product photographs, videos and sound recordings are intended to represent the product and its characteristics but should not be understood as a guarantee that every individual instrument will look or sound exactly identical to the material shown online.
2. Product Availability
Some instruments shown on our website may be available for immediate purchase, while others are made specifically after an order is placed.
Where an instrument is made to order, the manufacturing and delivery timeline shown on the website is an estimate and not a guaranteed delivery date.
Handcrafted instruments can occasionally require additional time for manufacturing, finishing, tuning, quality control or other processes.
3. Custom Orders and Scale Selection
For instruments made to order, the scale and other specifications selected by the customer are used to begin the manufacturing process.
Once work on the instrument has commenced, the selected scale cannot be changed.
Changes requested after manufacturing has begun may not be possible and, where possible, may result in additional charges or delays.
Custom engraving, finish and other personalization requests may also affect the manufacturing timeline.
4. Prices
Prices displayed on the website are the prices applicable to the relevant region, currency and product configuration at the time of purchase.
Once an order has been successfully placed and payment has been received, the product price applicable to that confirmed order will not be changed by Chirp Handpans.
Applicable taxes, duties, customs charges and other government-imposed charges may vary depending on the customer’s country and delivery location.
Unless specifically stated otherwise, customs duties, import taxes, clearance charges and other charges imposed by the destination country are the responsibility of the customer.
5. Payment Options
Depending on the customer’s location and the order, Chirp Handpans may offer the following payment options:
5.1 Pay in Full
The customer may pay the full order amount at the time of purchase.
Where Direct Bank Payment is selected and the checkout specifically displays a direct-payment discount, the applicable discount is applied to the order total.
The direct-payment discount applies only to eligible Pay in Full orders and does not apply to reservation payments or subsequent balance payments.
Payments made through Razorpay do not receive the Direct Bank Payment discount.
5.2 Reserve Now — Pay Before Shipping
Customers may reserve an order by paying 20% of the order amount at the time of purchase.
The remaining 80% balance must be paid before the order is shipped.
Reservation payments under this plan are processed through Razorpay.
A 2.36% payment fee is applied to the 20% reservation amount. This fee is payable at the time of reservation and is included in the amount shown as payable at checkout.
The balance due before shipping does not include this payment fee again.
5.3 Reserve Now — Pay on Delivery
Customers in India may, where offered at checkout, reserve an order by paying 20% of the order amount at the time of purchase.
The remaining 80% balance is payable upon delivery.
A 3.5% COD handling charge is applied to the remaining 80% balance.
The COD handling charge is payable together with the remaining balance at the time of delivery.
Cash on Delivery is available only for eligible orders and delivery locations within India and may be unavailable for certain products, locations or circumstances.
5.4 Payment Amounts Displayed at Checkout
The checkout page will display the amount payable immediately and, where applicable, the remaining balance and applicable payment-plan charges.
Customers are responsible for reviewing the payment plan, amounts and charges displayed at checkout before completing their order.
6. Reservation Payments
A reservation payment represents a commitment to manufacture or fulfil the selected order.
For made-to-order instruments, production may begin after the reservation payment has been received.
Once manufacturing has commenced, the selected scale and certain other specifications may no longer be changed.
The reservation amount is not automatically refundable merely because a customer changes their mind after manufacturing has commenced.
The cancellation and refund provisions in these Terms apply to reservation orders.
7. Balance Payments
For orders placed under a reservation plan, the outstanding balance must be paid according to the payment plan selected at checkout.
For Pay Before Shipping, the balance must be paid before the instrument is shipped.
For Pay on Delivery, the balance, including the applicable COD handling charge, must be paid at the time of delivery.
Where Chirp Handpans provides an online balance-payment facility, the customer may use the payment methods made available through that facility.
Any payment processing charges applicable to a subsequent payment will be displayed before that payment is completed.
8. Cancellation
Customers may request cancellation of an order by contacting Chirp Handpans.
For made-to-order instruments, a cancellation after manufacturing or preparation has commenced will result in ₹10,000 being retained from the amount paid towards the crafting and preparation commitment.
The remaining eligible amount, if any, will be refunded using the applicable refund method.
If a cancellation request is made before work has commenced, Chirp Handpans may, at its discretion, process the cancellation subject to any costs already incurred specifically for the order.
Customized engraving, special materials, special finishes or other bespoke work may involve additional non-recoverable costs.
9. Manufacturing Delays
The manufacturing and delivery timelines displayed on the website are estimates.
While Chirp Handpans makes reasonable efforts to complete orders within the stated timeframe, handmade manufacturing is subject to variables that may occasionally cause delays.
If an order is delayed substantially beyond the stated estimated timeline due to circumstances within or beyond our control, we will communicate the revised expected timeline to the customer.
Where a made-to-order handpan has not been delivered within 8 weeks beyond the originally communicated manufacturing timeline, the customer may request cancellation and a refund of the advance paid, subject to any specific written agreement applicable to the order.
This provision does not apply to delays caused by the customer’s failure to provide required information, approve specifications, make required payments, accept delivery, or complete customs/import formalities.
10. Shipping and Delivery
Chirp Handpans ships instruments from India using appropriate shipping and courier partners.
Shipping arrangements and estimated delivery times may vary depending on the destination country, courier availability, customs processing and other circumstances.
Where free worldwide shipping is specifically stated for a product, the stated shipping offer covers the shipping terms described on the relevant product/order page.
If the actual shipping cost exceeds the shipping allowance or conditions stated for the order, Chirp Handpans may request the customer to pay the applicable difference before shipment.
The customer is responsible for providing a complete and accurate shipping address and contact information.
Chirp Handpans is not responsible for delays resulting from incorrect or incomplete address information supplied by the customer.
11. Customs, Import Duties and Taxes
International shipments may be subject to customs duties, import taxes, VAT, GST, brokerage fees, clearance charges or other charges imposed by the destination country.
These charges are the responsibility of the customer unless explicitly stated otherwise at checkout.
Chirp Handpans does not control the amount of customs duties or taxes imposed by foreign authorities and cannot guarantee that a shipment will be released within a particular timeframe.
Customers are responsible for complying with the import requirements of their country.
12. Inspection on Delivery
Customers should inspect the package and instrument as soon as reasonably possible after delivery.
If the package appears seriously damaged, customers should photograph the packaging and instrument before discarding any packaging material and contact Chirp Handpans as soon as possible.
Any shipping damage should be reported promptly with photographs and supporting information so that we can investigate the matter with the shipping provider.
13. Returns and Refunds
Because Chirp Handpans are handmade instruments and many orders are produced specifically according to the customer’s selected scale, configuration or personalization, returns are not treated in the same manner as ordinary mass-produced goods.
A return or refund for a custom or made-to-order instrument is subject to the circumstances of the order and the applicable provisions of these Terms.
An instrument that has been damaged, modified, engraved, refinished, repaired or otherwise altered after delivery may not be eligible for return or refund.
Where Chirp Handpans agrees to a refund, the refund amount and method will depend on the circumstances of the order.
Payment gateway charges, shipping charges, customs charges and other third-party charges may not be refundable where they have already been incurred and cannot be recovered.
Nothing in these Terms limits any rights that cannot legally be excluded under applicable law.
14. Warranty
Chirp Handpans provides a 3-year warranty against rust and detuning for eligible handpans under normal use.
The warranty is intended to cover manufacturing-related issues affecting the instrument’s tuning or corrosion resistance.
The warranty does not cover damage resulting from accidents, impact, misuse, neglect, unauthorized modification or repair, inappropriate storage, extreme environmental exposure, improper transportation after delivery, or other damage caused by circumstances outside normal use.
If you believe your instrument has developed a warranty issue, contact Chirp Handpans with your order details and photographs or recordings where appropriate. We will assess the issue and determine the appropriate remedy.
15. Care and Maintenance
Customers are responsible for following the care and maintenance recommendations provided with their instrument.
The instrument should be protected from prolonged exposure to moisture, corrosive environments, extreme temperatures and other conditions that may adversely affect the steel, finish or tuning.
Only suitable cleaning and maintenance products should be used.
Unauthorized modifications, drilling, welding, refinishing, aggressive polishing or other alterations may affect the instrument and may void applicable warranty coverage.
16. Sound and Tuning Characteristics
Handpans are acoustic musical instruments made from formed and tuned steel.
Changes in temperature, humidity, transportation conditions and playing conditions can temporarily or permanently affect tuning.
The acoustic response of an individual instrument is influenced by its construction, playing technique and environment.
No guarantee is made that an instrument will have identical sustain, volume, resonance or tonal characteristics to another instrument of the same scale.
17. Photographs, Videos and Product Descriptions
We make reasonable efforts to ensure that product photographs, videos, descriptions and specifications are accurate.
However, colours may appear differently depending on the customer’s display and lighting conditions.
Because each instrument is handmade, minor differences between the product shown in photographs and the instrument delivered to the customer may occur.
Such differences do not automatically constitute a manufacturing defect.
18. Order Acceptance
Submitting an order through the website constitutes an offer to purchase the selected product under these Terms.
An order is considered accepted when Chirp Handpans has successfully received the applicable payment and confirmed the order.
Chirp Handpans reserves the right to cancel an order in exceptional circumstances, including pricing errors, inventory errors, payment problems, inability to fulfil a requested specification, suspected fraudulent activity, or circumstances beyond our reasonable control.
Where an order is cancelled by Chirp Handpans and payment has already been received, the eligible amount will be refunded.
19. Payment Fraud and Chargebacks
Customers must not use fraudulent payment methods, unauthorized payment instruments or false information when placing an order.
If a payment is reversed, disputed or charged back without a valid basis after an order has been fulfilled or manufacturing has commenced, Chirp Handpans reserves the right to recover the outstanding amount and any reasonable costs arising from the dispute.
Customers should contact Chirp Handpans directly if there is a genuine issue with an order or payment so that it can be investigated.
20. Intellectual Property
All photographs, videos, product descriptions, graphics, logos, text, designs, software and other content published on the Chirp Handpans website are the property of Chirp Handpans or their respective licensors.
Such content may not be reproduced, copied, modified, distributed or commercially used without prior written permission.
21. Limitation of Liability
To the extent permitted by applicable law, Chirp Handpans will not be liable for indirect, incidental or consequential losses arising from the purchase, delivery or use of a product.
Chirp Handpans’ liability in relation to a particular order will, to the extent permitted by law, be limited to the amount paid by the customer for that order.
Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law.
22. Events Beyond Our Control
Chirp Handpans will not be responsible for delays or inability to fulfil an order caused by circumstances beyond our reasonable control, including natural disasters, fire, war, government restrictions, customs restrictions, transportation disruptions, courier failures, strikes, supply-chain disruptions, epidemics, infrastructure failures or other comparable events.
Where such circumstances occur, we will make reasonable efforts to communicate with affected customers and provide an updated estimated timeline.
23. Privacy
Customer information is handled in accordance with the Chirp Handpans Privacy Policy.
By placing an order, the customer consents to Chirp Handpans using the information necessary to process the order, arrange payment, manufacture the instrument, communicate with the customer and arrange delivery.
Payment information is processed through the applicable payment service provider and is subject to that provider’s terms and privacy policies.
24. Changes to These Terms
Chirp Handpans may update these Terms & Conditions from time to time.
The version applicable to an order will generally be the version published on the website at the time the order is placed, unless otherwise required by law or expressly agreed in writing.
25. Governing Law and Jurisdiction
These Terms & Conditions are governed by the laws of India.
Subject to applicable law, disputes arising from an order or these Terms will be subject to the jurisdiction of the courts having jurisdiction over Bengaluru, Karnataka, India.
